Tenant Selection Criteria
LANDLORD’S LEASING CRITERIA AND GROUNDS FOR DENIAL
The landlord/owner of the above stated property operates in compliance with the Fair Housing Act. The act prohibits discrimination in housing based on race, color, religion, sex, national origin, handicap or familial status.
These Tenant Selection Criteria are being provided to you prior to your application pursuant to Texas Property Code Section 92.3515. The following constitute grounds upon which Landlord will be basing the decision to lease the Property to You. The tenant selection criteria may include items such as rental history, employment history, criminal background, credit history, current income, etc. If applicant does not meet the selection criteria, or provides inaccurate or incomplete information, the application may be rejected and the application fee will not be refunded. If your application is denied based upon information obtained from your credit report, you will be notified.
1. Criminal History: Landlord will perform a criminal history check on you to verify the information provided by you on the Lease Application. Those with a criminal history need not apply. Landlord’s decision to lease the Property to you may be influenced by the information contained in this report.
2. Previous Rental History: Landlord will verify your previous rental history using the information provided by you on the Lease Application. A minimum of 2-year verifiable rental history OR minimum 2-year verifiable mortgage payments is required. Your failure to provide the requested information, provision of inaccurate information, or information learned upon contacting previous landlords may influence Landlord’s decision to lease the property to you. Those with eviction history need not apply.
3. Current Income: Landlord will ask you to verify your income as stated on your lease application. Current income is to meet or exceed 2 1/2 times the monthly rent of the property. Depending upon the rental amount being asked for the Property, the sufficiency of your income, along with the ability to verify the stated income, may influence Landlord’s decision to lease the Property to you.
4. Credit History: Landlord will obtain a Credit Reporting Agency (CRS) report, commonly referred to as a credit report in order to verify your credit history. Landlord’s decision to lease the Property to you may be based upon information obtained from this report. Acceptable credit history required and may not contain any evictions, foreclosures with the past 7 years, and bankruptcies within the last 7 years, or judgment liens regarding rent and/or property damages. A minimum credit score of 650 is required. If your application is denied based upon information obtained from your credit report, you will be notified.
5. Failure to Provide Accurate Information in Application: Your failure to provide accurate information in your application, or your provision of information that is unverifiable, will be considered by Landlord when making the decision to lease the Property to you.
The stated rental amount is based on the applicant’s ability to meet the additional criteria that follows:
• All occupants 18 years of age and older must be principal to the lease, have a valid U.S Social Security number and must submit a signed application
• Employers verification of 12-month employment history is required
• Verifiable positive 24 month rental or mortgage history is required
• Smoking anywhere on the property is prohibited
• Drug use anywhere on the property is prohibited
• Pets anywhere on the property is prohibited unless previously approved by landlord
• A maximum of 3 automobiles is allowed
• Failure to return a completed property condition and inventory report within 10 days of tenant possession will result in forfeiture of all deposits.
• All deposits and full first month rental payment is due within 24 hours of lease execution. 2nd month rental payments will be pro-rated as necessary.
• Any and all damages beyond normal wear and tear at lease end will be deducted from your deposit in accordance with the Texas Property Code. In addition to any damages to the structure itself, other damages including but not limited to dead grass and landscaping, odor remediation and trash removal will be deducted from all deposits.
• To preserve the home’s foundation, lawn, and landscaping, the watering schedule in the lease must be followed explicitly.
• Yard maintenance is at tenants expense. Trampolines or dough boy pools are not permitted on the property.
• Ventilation fans in bathrooms must be used with showers to remove moisture and inhibit mold.
• Rental deposit may NOT be used as last month rent payment.
• Roommates must combine rental payments and pay the rent with one payment,separate roommate checks are not allowed.
• Each application must include:
• 4-page application form
• A clear, enlarged copy of each applicant’s valid driver’s license
• A signed copy of this criteria form
Tenant selection criteria MUST BE ACKNOWLEDGED by applicant at the time of application. Signing this acknowledgement indicates that applicant has had the opportunity to review the landlord’s tenant selection criteria. Please check your application package carefully before submitting it, make sure it is legible and completely filled out. Incomplete applications will not be considered or processed and application fees will not be refunded.
Failure to make tenant selection criteria available to potential tenants who are later denied could result in a landlord’s inability to retain any application fee or deposit, therefore, this notice is part of your application and your lease agreement. This notice must be signed and returned with your tenant application. Please keep a copy for your files/records.
